TERMS OF SERVICE

These Terms of Service govern access to the Ordessa website and purchases made from Ordessa.
Ordessa operates under ABN 15 377 158 696.
In these Terms, “Ordessa”, “we”, “us” and “our” refer to the business operating this store. “You” and “your” refer to a website visitor, customer or account holder.
1. Acceptance of these Terms
By accessing this website, creating an account or placing an order, you agree to these Terms together with our:

Shipping Policy;
-
Returns and Refund Policy; and
-
Privacy Policy.
If you do not agree, you should not use the website or place an order.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
2. Eligibility
You must be legally capable of entering into a binding agreement to place an order.
If you place an order on behalf of another person or organisation, you confirm that you have authority to do so.
You must provide accurate, complete and current information when using the website or placing an order.
3. Website and product information
Ordessa takes reasonable care to keep product information, availability, prices and website content accurate.
Product appearance may vary slightly depending on lighting, photography and device-display settings. This does not permit Ordessa to supply a product that is materially different from its description.
Measurements described as approximate may be subject to reasonable manufacturing tolerances.
Customers should review all available dimensions and measurement guidance before ordering where exact fit is important.
Product materials, dimensions and specifications may be based on information supplied by the relevant manufacturer or fulfilment partner unless Ordessa states that it has independently verified them.
Customers should contact support@ordessa.com.au before ordering if important information is unclear.
4. Products and availability
Products may be available in limited quantities and may become unavailable without notice.
Adding a product to a cart does not reserve inventory.
Ordessa may place reasonable limits on purchase quantities where necessary to manage supply, prevent suspected unauthorised resale or address an apparent pricing or inventory error.
If a purchased product becomes unavailable, Ordessa will contact the customer and provide an appropriate solution, which may include:

offering an alternative product for the customer’s approval;
-
providing a replacement;
-
cancelling the affected product; or
-
issuing a refund.
Ordessa will not substitute a materially different product without the customer’s agreement.
5. Prices and GST
Prices are displayed in Australian dollars.
Prices include GST where applicable unless clearly stated otherwise.
Delivery charges and optional services are displayed before checkout is completed.
Ordessa may change prices prospectively. A price change will not alter an order already accepted except where the displayed price was an obvious and genuine error and applicable law permits correction.
If more than one price is displayed for the same product, Ordessa will comply with applicable Australian pricing laws.
6. Orders
Submitting an order is an offer to purchase the products displayed in the customer’s cart.
An automated order-confirmation email acknowledges receipt of the order. It does not necessarily mean that the order has been accepted for fulfilment.
Ordessa may decline or cancel an order before dispatch where reasonably necessary, including where:
-
payment is not authorised;
-
the product is unavailable;
-
delivery to the supplied address is not possible;
-
there is an obvious pricing or listing error;
-
the order appears fraudulent or unauthorised; or
-
accepting the order would breach a legal or regulatory obligation.
If Ordessa cancels an order after receiving payment, the affected amount will be refunded to the original payment method.
Ordessa will not cancel orders arbitrarily or for reasons prohibited by law.
7. Payment
Payment must be completed using a payment method made available during checkout.
The customer confirms that:
-
the payment information supplied is accurate;
-
the customer is authorised to use the selected payment method; and
-
sufficient funds or credit are available.
Payments may be processed by Shopify, PayPal or another third-party payment provider. Separate terms and privacy practices may apply to the services provided by those businesses.
Ordessa does not directly store complete payment-card details.
8. Delivery
Delivery is governed by the Shipping Policy.
Order processing is included within the estimated total delivery period.
Most Australian orders are expected to arrive within approximately 5–12 business days after the order is placed. Remote locations may take up to 15 business days.
Delivery dates are estimates unless Ordessa expressly agrees to a guaranteed date in writing.
Customers are responsible for providing a complete and accurate delivery address.
Orders may be fulfilled from different locations and may arrive in separate parcels.
Ordessa remains the customer’s point of contact for delivery problems relating to an Ordessa order.
9. Returns and refunds
Returns, cancellations and refunds are governed by the Returns and Refund Policy and the Australian Consumer Law.
Ordessa’s 14-day change-of-mind policy operates in addition to consumer guarantees.
Conditions applying to voluntary change-of-mind returns do not restrict remedies for products that are faulty, unsafe, damaged, misdescribed or otherwise fail to satisfy a consumer guarantee.
Customers are not required to contact a manufacturer or fulfilment partner to request a remedy from Ordessa.
10. Customer accounts
Customers may be able to create an account.
Customers are responsible for:
-
maintaining the confidentiality of their login details;
-
activity conducted through their account; and
-
notifying Ordessa promptly of suspected unauthorised access.
Ordessa may suspend access where reasonably necessary to protect customers, investigate suspected fraud or maintain website security.
11. Acceptable website use
The website may only be used for lawful purposes.
Users must not:
-
use the website for fraud or unlawful conduct;
-
interfere with website security or operation;
-
introduce malicious software;
-
collect customer or website data without authorisation;
-
impersonate another person;
-
use automated systems to place abusive or fraudulent orders;
-
attempt to gain unauthorised access to an account or system;
-
reproduce protected website content without permission; or
-
use the website in a manner that infringes another person’s rights.
12. Intellectual property
Unless otherwise stated, the Ordessa name, branding, original website design, original copy, graphics and other original content are owned by or licensed to Ordessa.
Users may view and use this content for ordinary personal shopping purposes.
Protected content must not be reproduced, republished, commercially exploited or misrepresented without prior written permission, except where permitted by law.
Third-party product imagery, trademarks and content remain the property of their respective owners.
13. Reviews and submitted content
If a customer submits a review, photograph, comment or other content, the customer confirms that:
-
it reflects their honest experience;
-
they have the right to submit it;
-
it does not infringe another person’s rights;
-
it is not unlawful, defamatory, threatening or deceptive; and
-
it does not contain malicious software or undisclosed advertising.
The customer gives Ordessa non-exclusive permission to display and reproduce submitted content for operating and promoting the business, subject to applicable privacy law.
Ordessa may moderate or remove content for legitimate reasons. Ordessa will not selectively suppress genuine negative reviews solely because they are unfavourable.
14. Third-party services and links
The website may use or link to services provided by Shopify, payment processors, delivery carriers, analytics providers and other third parties.
A third-party link does not necessarily mean that Ordessa endorses every statement, product or service offered by that third party.
Third-party services may be governed by separate terms and privacy policies.
Ordessa remains responsible for obligations that cannot lawfully be transferred or excluded.
15. Privacy
Personal information is handled in accordance with the Ordessa Privacy Policy and applicable privacy law.
Information may be processed by service providers involved in operating the store, processing payments, preventing fraud, fulfilling orders and providing customer support.
16. Promotions and discount codes
Promotions may be subject to:
-
an expiry date;
-
minimum purchase requirements;
-
product exclusions;
-
limits per customer; and
-
restrictions on combining offers.
Conditions will be displayed with the relevant promotion.
Discount codes must be entered before checkout is completed. Ordessa is not required to apply a discount retrospectively where the code was not entered, unless the failure resulted from an error for which Ordessa is responsible.
Promotions do not affect consumer guarantee rights.
17. Liability
Nothing in these Terms limits liability or remedies where doing so would be unlawful.
To the maximum extent permitted by law, Ordessa is not responsible for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.
This limitation does not apply where loss results from:
-
negligence by Ordessa;
-
fraud or wilful misconduct;
-
breach of a consumer guarantee;
-
breach of a product-safety obligation; or
-
another liability that cannot legally be excluded.
Every limitation in these Terms must be interpreted subject to the Australian Consumer Law.
18. Events outside reasonable control
Ordessa is not responsible for delay caused by events outside its reasonable control, including natural disasters, severe weather, carrier disruption, industrial action, government restrictions or widespread system outages.
Ordessa will still take reasonable steps to:

communicate material delays;
-
reduce their effect;
-
fulfil the order where reasonably possible; and
-
provide any remedy required by law.
19. Changes to these Terms
Ordessa may update these Terms to reflect changes to the website, business operations or applicable law.
Changes apply prospectively from the date the updated Terms are published.
An update will not retrospectively remove customer rights or materially alter an order already accepted unless the customer agrees or the law permits the change.
The latest revision date will appear at the beginning of these Terms.
20. Severability
If part of these Terms is found to be invalid or unenforceable, that part will be interpreted or removed to the minimum extent necessary.
The remaining provisions will continue to operate.
21. Governing law
These Terms are governed by the laws applicable in Queensland, Australia.
The parties submit to courts and tribunals with lawful jurisdiction.
This provision does not prevent a customer from relying on rights or forums available under applicable consumer law.
